To purchase a property in Spain is actually a relatively simple process when a proper search has been done by the estate agency.  This will include the most important document which is the `Nota Simple´ or Registrar´s Slip.

Once you have found your ideal property, there is usually a three stage purchasing process:-

Reserval:  It is advisable to pay an amount ‘señal’ which will take the property off the market, reserve it for you and fix the price.  This is ususally anywhere between 3-6.000 Euros. A short contract is signed by both parties which serves as a receipt and gives the buyer the “option to buy”. 

Private Contract:  Within aprox.14 days of the initial reservation, the private contract  is drawn up to meet the specific needs of both the vendor and the buyer.  This will stipulate all the terms and conditions concerning the purchase of your property.  At this stage the contract is signed by both parties and the balance of the deposit agreed upon is paid.  (This is usually 10% of the price).

Completion :  The day you go to the notary to sign the deed or ‘escritura’ and take possession of your property the outstanding balance is paid and the purchase is completed.  Our office pays a “gestor” or solicitor to do all of the follow-up work  for both the vendor and buyer which includes: registration of the title deed, paying the “Plusvalia” (tax to the Municipal Town Hall) for the vendor,  paying the Notary charges, name and title changes for IBI (property “rates” taxes), electricity and water.
